EveryDay Labs takes student privacy seriously. We know how important privacy is to our school district partners and to the students and families whose data we collect. At EveryDay Labs, we collect data from our school district partners and incorporate that data into products designed to reduce absenteeism. This policy outlines the types of data that we collect and the ways in which we use, disclose, and protect that data. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy. 

Remember that your use of EveryDay Labs' Services is at all times subject to our Terms of Use, which incorporates this Privacy Policy. If there is a discrepancy between our privacy policy and a contract with a particular school district, the contract takes precedence.

What this Privacy Policy Covers

This Privacy Policy covers how we handle Personal Data and Student Data that we gather when you access or use our Services.
-Personal Data:  Information that identifies or relates to an individual, including information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws. 
-Student Data: Information collected on students within a school district or provided to us by school district partners to deliver our products and measure results. This includes directory information (such as mailing addresses and parent/guardian contact information), attendance data, and demographic data. In the course of providing our Services, we may collect additional information on students from platform users, through address and phone number verification processes, or through family engagement with our Family Support Team or Family Support Bot. We treat all student data as highly confidential and take great care in protecting it.

While the school district provides us with access to student data, it is the district and not EveryDay Labs that ultimately retains ownership and control of all Student Data that EveryDay Labs uses.

Tracking Tools and Opt-Out

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Please note that because of our use of Cookies, the Services do not support “Do Not Track” requests sent from a browser at this time.

Purposes for Collecting Data:

-To provide, customize, and improve our services, in compliance with our contract and in accordance with the standards set forth in the Family Educational Rights and Privacy Act (FERPA).
-For marketing and corresponding with platform users.
-To meet legal requirements and enforce legal terms.

Information We Share

We disclose Personal Data to the following categories of service providers and other parties:

-Service Providers: Hosting, technology, communication providers.
-Analytics Partners: Companies that track user interactions and provide insights.
-Business Partners: Schools or districts, and companies we partner with for promotional offers.
-Legal Obligations: To comply with legal requests and protect rights.
-Business Transfers: In case of merger, acquisition, or bankruptcy.

Student Data
We never sell, rent, or trade student data. We only share student data in specific scenarios:
-External Service Providers: To support our operations, with strict contractual privacy obligations.
-Legal Requests: To comply with court orders or other legal processes, notifying the school district if permissible.
-Successor Entities: With advance notice and only to entities with similar or stricter privacy policies.
-Back to Schools: Sharing data with authorized school district personnel as part of our services.

Data Security and Retention
We protect your data using industry standard security measures, including encryption and secure storage. All data remains within the United States. Access to data is limited to authorized personnel and vendors. In case of a data breach, we will promptly notify the affected school district.

We retain student data only as long as necessary to provide our services or as required by contract. Upon termination of a contract or at the school district's request, we will delete all associated student data. Personal Data is retained as long as necessary for service provision, legal obligations, and dispute resolution.

Help us protect data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. 

Family Rights
Parents, guardians, and eligible students must work directly with their school district to modify or delete student data. Parents and guardians can opt-out of communications by contacting us at the provided email or phone number. Opting out will not delete a student’s data from our records but will prevent a parent or guardian from receiving our communications. 

Children’s Privacy
We comply with the Children’s Online Privacy Protection Act (COPPA). We collect information on children under 13 only from authorized school district personnel with verifiable parental consent. If we learn of unauthorized data collection from children under 13, we will delete it promptly. Parents can contact the school district to stop data collection or request data deletion.

California Resident Rights
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA):
-Access: Request information about our data collection and sharing practices.
-Deletion: Request the deletion of your Personal Data, subject to certain exceptions.
-Exercising Rights: Submit requests via call, email, or form, providing sufficient information for identity verification.

We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an “Authorized Agent”) to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

Other State Law Privacy Rights

-Nevada Residents: Opt-out of the sale of certain Personal Data by contacting us with a "Nevada Do Not Sell Request."

Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes through our website, email, or other means. Continued use of our services after changes have been posted indicates acceptance of the updated policy.
